LEGE nr. 327 din 16 decembrie 2015

pentru aprobarea Ordonanţei Guvernului nr. 39/2015 privind cazierul fiscal

Parlamentul României adoptă prezenta lege.

Articolul I

Se aprobă Ordonanţa Guvernului nr. 39 din 26 august 2015 privind cazierul fiscal, adoptată în temeiul art. 1 pct. I.5 din Legea nr. 182/2015 privind abilitarea Guvernului de a emite ordonanţe şi publicată în Monitorul Oficial al României, Partea I, nr. 655 din 31 august 2015, cu următoarea modificare:

- La articolul 5, alineatul (3) se modifică şi va avea următorul cuprins:

"(3) Organele competente să constate faptele prevăzute la art. 4 şi să aplice sancţiuni au obligaţia ca, în termen de 5 zile de la data rămânerii definitive a actelor care sancţionează fapte care, potrivit legii, se înscriu în cazierul fiscal, neatacate în termenele prevăzute de lege, să comunice aceste acte, în copie, organului fiscal competent în a cărui rază teritorială îşi are domiciliul fiscal contribuabilul sancţionat."

Articolul II

Faptele sancţionate contravenţional cu avertisment, care sunt înscrise în cazierul fiscal al contribuabililor la data intrării în vigoare a prezentei legi, se scot din evidenţă începând cu această dată.

Această lege a fost adoptată de Parlamentul României, cu respectarea prevederilor art. 75 şi ale art. 76 alin. (2) din Constituţia României, republicată.
