În temeiul art. 107 din Constituţie şi al art. 1 pct. II.2 din Legea nr. 279/2003 privind abilitarea Guvernului de a emite ordonanţe,

Guvernul României adopta prezenta ordonanţă.

Articolul UNIC

După alineatul (1) al articolului 7 din Ordonanţa de urgenta a Guvernului nr. 8/2003 privind stimularea procesului de restructurare, reorganizare şi privatizare a unor societăţi naţionale, companii naţionale şi societăţi comerciale cu capital majoritar de stat, publicată în Monitorul Oficial al României, Partea I, nr. 144 din 5 martie 2003, cu modificările şi completările ulterioare, se introduce un nou alineat, alineatul (1^1), cu următorul cuprins:

"(1^1) Dispoziţiile prezentei ordonanţe de urgenţă se aplică şi persoanelor care la data de 1 ianuarie 2003 îşi desfasurau activitatea în sectorul feroviar la unităţile prezentate în anexa la Hotărârea Guvernului nr. 839/2003, cărora li s-au desfăcut contractele de muncă după această dată, în temeiul art. 55 din Legea nr. 53/2003 - Codul muncii, şi care au fost reincadrate în unităţile prevăzute în anexa la Hotărârea Guvernului nr. 839/2003 şi se disponibilizeaza prin concedieri colective."
