LEGE nr. 319 din 27 mai 2002

pentru modificarea şi completarea Ordonanţei Guvernului nr. 105/1999 privind acordarea unor drepturi persoanelor persecutate de către regimurile instaurate în România cu începere de la 6 septembrie 1940 până la 6 martie 1945 din motive etnice, aprobată prin Legea nr. 189/2000

Parlamentul României adopta prezenta lege.

Articolul 1

Ordonanţa Guvernului nr. 105 din 30 august 1999 privind acordarea unor drepturi persoanelor persecutate de către regimurile instaurate în România cu începere de la 6 septembrie 1940 până la 6 martie 1945 din motive etnice, publicată în Monitorul Oficial al României, Partea I, nr. 426 din 31 august 1999, aprobată prin Legea nr. 189/2000, cu modificările şi completările ulterioare, se completează după cum urmează:

1. După articolul 6 se introduce articolul 6^1 cu următorul cuprins:

"Art. 6^1. - Dovedirea situaţiilor prevăzute la art. 1 se face de către persoanele interesate, cu acte oficiale eliberate, la cerere, de către organele competente, iar în cazul în care aceasta nu este posibil, prin orice mijloc de proba prevăzut de lege."

2. La articolul 7, alineatul (2) va avea următorul cuprins:

"(2) Cererile pentru stabilirea drepturilor prevăzute în prezenta ordonanţă se depun la casele judeţene de pensii sau, după caz, la Casa de Pensii a Municipiului Bucureşti."

3. După articolul 11 se introduce articolul 12 cu următorul cuprins:

"Art. 12. - Ministerul Muncii şi Solidarităţii Sociale, cu consultarea Ministerului Informaţiilor Publice, Ministerului de Interne şi Ministerului Apărării Naţionale, va elabora normele metodologice de aplicare a prezentei ordonanţe, pe care le va supune spre aprobare Guvernului."

Articolul 2

Elaborarea normelor metodologice prevăzute la art. 12 din Ordonanţa Guvernului nr. 105/1999 se face în termen de 30 de zile de la data intrării în vigoare a prezentei legi.

Această lege a fost adoptată de Senat în şedinţa din 22 aprilie 2002, cu respectarea prevederilor art. 74 alin. (2) din Constituţia României.
