pentru ratificarea Protocolului adiţional, adoptat la Strasbourg la 28 ianuarie 2003, la Convenţia Consiliului Europei privind criminalitatea informatică, referitor la incriminarea actelor de natură rasistă şi xenofobă săvârşite prin intermediul sistemelor informatice

Parlamentul României adoptă prezenta lege.

Articolul 1

Se ratifică Protocolul adiţional, adoptat la Strasbourg la 28 ianuarie 2003, la Convenţia Consiliului Europei privind criminalitatea informatică, referitor la incriminarea actelor de natură rasistă şi xenofobă săvârşite prin intermediul sistemelor informatice, ratificată prin Legea nr. 64/2004, publicată în Monitorul Oficial al României, Partea I, nr. 343 din 20 aprilie 2004.

Articolul 2

Cu ocazia depunerii instrumentului de ratificare, în conformitate cu prevederile art. 5 paragraful 2 lit. b) din Protocolul adiţional, România formulează următoarea rezervă:

"România îşi rezervă dreptul de a nu aplica dispoziţiile paragrafului 1 al art. 5 din Protocol, privind insulta având la bază o motivaţie rasistă şi xenofobă."

Această lege a fost adoptată de Parlamentul României, cu respectarea prevederilor art. 75 şi ale art. 76 alin. (2) din Constituţia României, republicată.
