ORDONANTA nr. 11 din 29 ianuarie 1998

pentru modificarea şi completarea Legii nr. 146/1997 privind taxele judiciare de timbru

În temeiul art. 107 alin. (1) din Constituţia României, precum şi al art. 1 lit. t) din Legea nr. 221/1997 privind abilitarea Guvernului de a emite ordonanţe,

Guvernul României emite următoarea ordonanţa:

Articolul 1

Legea nr. 146/1997 privind taxele judiciare de timbru, publicată în Monitorul Oficial al României, Partea I, nr. 173 din 29 iulie 1997, se modifica şi se completează după cum urmează:

1. La articolul 3, după litera t,) se introduce litera t,^1), cu următorul cuprins:

"t,^1) cereri pentru eliberarea oricăror alte certificate prin care se atesta fapte sau situaţii rezultate din evidentele instanţelor de judecată sau cu privire la dosarele aflate în arhiva acestora .......... 2.000 lei;"

2. La articolul 6, textul introductiv va avea următorul cuprins:

"Art. 6. - În materie comercială, se taxeaza următoarele cereri:"

3. La articolul 9, după alineatul (6) se introduce alineatul (7), cu următorul cuprins:

"(7) Eliberarea certificatelor de sarcini în urma cercetării registrelor de transcripţiuni şi inscriptiuni şi, după caz, a extraselor sau copiilor de carte funciară se taxeaza cu 5.000 lei."

4. La articolul 15, după litera f) se introduce litera f^1), cu următorul cuprins:

"f^1) stabilirea şi acordarea daunelor morale pentru prejudicii aduse onoarei, demnităţii sau reputaţiei unei persoane fizice;"

5. Articolul 15 litera r) se modifica şi va avea următorul cuprins:

"r) cererile introduse de proprietari sau de succesorii acestora pentru restituirea imobilelor preluate de stat sau de alte persoane juridice în perioada 6 martie 1945 - 22 decembrie 1989."

6. Articolul 17 va avea următorul cuprins:

"Art. 17. - Sunt scutite de taxa judiciară de timbru cererile şi acţiunile, inclusiv căile de atac formulate, potrivit legii, de Guvernul României, de Ministerul Public şi de Ministerul Finanţelor, precum şi cele formulate de alte instituţii publice, când au ca obiect venituri publice."

7. După articolul 17 se introduce articolul 17^1, cu următorul cuprins:

"Art. 17^1. - Sunt scutite de taxa judiciară de timbru cererile pentru înregistrarea asociaţiilor de proprietari, adresate judecătoriei, precum şi transcrierea titlurilor de proprietate sau, după caz, a contractelor de dobândire a apartamentelor din clădirile cu mai multe locuinţe, în vederea constituirii asociaţiei de proprietari."

8. Articolul 19 se modifica şi va avea următorul cuprins:

"Art. 19. - (1) Taxele judiciare de timbru se plătesc de către persoanele fizice în numerar, în contul bugetului de stat, la unităţile trezoreriei statului sau ale Casei de Economii şi Consemnaţiuni.

(2) Persoanele juridice plătesc taxele judiciare de timbru până la 30.000 lei în numerar, potrivit alineatului precedent, iar taxele judiciare de timbru care depăşesc acest nivel se plătesc în numerar sau prin ordin de plată, în contul bugetului de stat, la unităţile trezoreriei statului în raza căreia au sediul fiscal." ...

Articolul 2

Legea nr. 146/1997 privind taxele judiciare de timbru, cu modificările şi completările aduse prin prezenta ordonanţă, se va republica în Monitorul Oficial al României, Partea I, dându-se textelor o noua numerotare.
