ORDONANŢĂ DE URGENŢĂ nr. 109 din 11 decembrie 2013

pentru completarea Ordonanţei de urgenţă a Guvernului nr. 194/2002 privind regimul străinilor în România

Dat fiind că actualul context impune adoptarea stringentă a tuturor măsurilor adecvate, menite să asigure premise pentru creşterea economică a României,

având în vedere potenţialul turistic, investiţional, al mediului de afaceri, al celui universitar şi ştiinţific din România, care pot fi valorificate în plan economic prin atragerea turiştilor, investitorilor, oamenilor de afaceri, cercetătorilor şi studenţilor străini,

ţinând cont de numeroasele solicitări de facilitare a regimului de vize, cu precădere pentru oamenii de afaceri, formulate în ultimul timp la nivel bilateral,

întrucât amânarea acordării unor astfel de facilităţi ar atrage prejudicii financiare şi de imagine semnificative pentru România,

luând în considerare avantajele majore şi imediate pe care le-ar aduce instituirea egalităţii de tratament din partea ţării noastre, în favoarea posesorilor de vize şi alte permise de şedere eliberate de statele Schengen,

anticipând efectele benefice pe termen lung, în multiple domenii, ale înlesnirii regimului călătoriilor străinilor în România,

în virtutea faptului că acestea constituie situaţii extraordinare, a căror reglementare nu poate fi amânată,

în temeiul art. 115 alin. (4) din Constituţia României, republicată,

Guvernul României adoptă prezenta ordonanţă de urgenţă.

Articolul I

După articolul 128^1 din Ordonanţa de urgenţă a Guvernului nr. 194/2002 privind regimul străinilor în România, republicată în Monitorul Oficial al României, Partea I, nr. 421 din 5 iunie 2008, cu modificările şi completările ulterioare, se introduce un nou articol, articolul 128^2, cu următorul cuprins:

"ART. 128^2

Facilităţi la intrarea pe teritoriul României a străinilor titulari ai unor documente eliberate de state Schengen

(1) Străinii titulari ai unor vize uniforme, valabile pentru două sau multiple intrări, ai unor vize de lungă şedere sau ai unor permise de şedere, altele decât cele prevăzute la art. 128 alin. (1), eliberate de state Schengen, pot intra pe teritoriul României în vederea unei şederi neîntrerupte sau a mai multor şederi a căror durată să nu depăşească 90 de zile în decursul oricărei perioade de 180 de zile precedente fiecărei zile de şedere pe teritoriul României, fără viză de scurtă şedere, dacă documentele prezentate sunt în perioada de valabilitate, iar numărul de intrări şi durata şederii autorizate nu au fost epuizate. ... (2) Durata şederii pe teritoriul României nu poate depăşi dreptul de şedere stabilit prin vizele uniforme, vizele de lungă şedere sau permisele de şedere prevăzute la alin. (1)." ...

Articolul II

Prezenta ordonanţă de urgenţă intră în vigoare la data de 1 februarie 2014.
