ORDONANTA nr. 53 din 14 august 1998

pentru completarea Legii nr. 26/1990 privind registrul comerţului

În temeiul prevederilor art. 107 alin. (1) şi (3) din Constituţia României şi ale art. 1 pct. 4 lit. l) din Legea nr. 148/1998 privind abilitarea Guvernului de a emite ordonanţe,

Guvernul României emite următoarea ordonanţa:

Articolul UNIC

Legea nr. 26/1990 privind registrul comerţului, republicată în Monitorul Oficial al României, Partea I, nr. 49 din 4 februarie 1998, se completează prin introducerea după alineatul (3) al articolului 11 a alineatelor (3^1), (3^2) şi (3^3), cu următorul cuprins:

"(3^1) Sumele virate Ministerului Justiţiei conform alin. (2) se gestionează şi se utilizează de către acest minister în regim extrabugetar, în condiţiile şi cu destinaţia prevăzute de lege pentru timbrul judiciar. Aceste prevederi se aplică şi sumelor încasate de Ministerul Justiţiei până la data prezentei ordonanţe, Ministerul Finanţelor urmând a efectua regularizările necesare.

(3^2) Repartizarea veniturilor pe categorii de cheltuieli se stabileşte prin ordin al ministrului justiţiei.

(3^3) Disponibilităţile de la finele anului ale sumelor prevăzute la alin. (3^1) rămân la dispoziţia Ministerului Justiţiei şi se vor reporta în anul următor, pentru a fi cheltuite cu aceeaşi destinaţie."
