Amendamente la anexele I, II, IV şi V la MARPOL

(pentru a conferi caracter obligatoriu

prevederilor referitoare la mediu din Codul polar)

Comitetul pentru protecţia mediului marin,

amintind art. 38(a) din Convenţia privind crearea Organizaţiei Maritime Internaţionale referitor la funcţiile Comitetului pentru protecţia mediului marin conferite acestuia prin convenţiile internaţionale pentru prevenirea şi controlul poluării marine de către nave,

luând notă de art. 16 din Convenţia internaţională din 1973 pentru prevenirea poluării de către nave, aşa cum a fost modificată prin Protocolul din 1978 referitor la aceasta, care specifică procedura de amendare şi conferă organismului corespunzător al Organizaţiei funcţia de examinare şi adoptare a amendamentelor la aceasta,

recunoscând necesitatea de a oferi un cadru obligatoriu pentru navele care operează în apele polare datorită cerinţelor suplimentare impuse navelor, sistemelor lor şi operării acestora, care sunt mai restrictive decât cerinţele existente ale MARPOL şi ale altor instrumente obligatorii relevante ale OMI,

luând notă de Rezoluţia MEPC.264(68), prin care Comitetul a adoptat Codul internaţional pentru nave care operează în ape polare (Codul polar), în ceea ce priveşte prevederile sale referitoare la mediu,

luând notă de asemenea că Comitetul de siguranţă maritimă, la cea de-a nouăzeci şi patra sa sesiune, a adoptat prin Rezoluţia MSC.385(94) Codul internaţional pentru nave care operează în ape polare (Codul polar) în ceea ce priveşte prevederile sale referitoare la siguranţă, iar prin Rezoluţia MSC.386(94), amendamente la Convenţia SOLAS 1974, pentru a face obligatorii prevederile referitoare la siguranţă din Codul polar,

luând în considerare propunerile de amendamente la anexele I, II, IV şi V la MARPOL pentru a face obligatorii prevederile referitoare la mediu din Codul polar,

1. adoptă, în conformitate cu art. 16(2)(d) din MARPOL, amendamentele la anexele I, II, IV şi V la MARPOL, al căror text este prezentat în anexa la prezenta rezoluţie;

2. stabileşte, în conformitate cu art. 16(2)(f)(iii) din MARPOL, că amendamentele se vor considera ca fiind acceptate la 1 iulie 2016, în afara cazului în care, înainte de această dată, cel puţin o treime din părţi sau părţile ale căror flote comerciale reprezintă în total nu mai puţin de 50% din tonajul brut al flotei comerciale mondiale vor fi comunicat Organizaţiei obiecţiile lor cu privire la amendamente;

3. invită părţile să ia notă că, în conformitate cu art. 16(2)(g)(ii) din MARPOL, amendamentele menţionate vor intra în vigoare la 1 ianuarie 2017, după acceptarea acestora conform paragrafului 2 de mai sus;

4. solicită secretarului general, în conformitate cu art. 16(2)(e) din MARPOL, să transmită tuturor părţilor la MARPOL copii certificate ale prezentei rezoluţii şi ale textului amendamentelor conţinute în anexă;

5. solicită în plus secretarului general să transmită membrilor Organizaţiei care nu sunt părţi la MARPOL copii ale prezentei rezoluţii şi ale anexei sale.
