ORDONANȚĂ DE URGENȚĂ nr. 71 din 17 iulie 2018

privind prorogarea termenului de administrare, de către organele fiscale de la nivel județean și al municipiului București, a obligațiilor fiscale datorate de contribuabilii mijlocii, de la data de 1 august 2018 la data de 1 noiembrie 2018

Luând în considerare necesitatea prorogării termenului de administrare a contribuabililor mijlocii de către organele fiscale de la nivel județean și al municipiului București de la data de 1 august 2018 la data de 1 noiembrie 2018,

în scopul evitării riscului ca contribuabilii mijlocii să nu poată fi administrați corespunzător, a riscului direct asupra colectării creanțelor bugetare, având în vedere ponderea veniturilor realizate de către acești contribuabili în bugetul general consolidat, se impune prorogarea termenului.

Ținând cont de situația obiectivă creată de reglementarea la nivel de lege a unui termen care nu poate fi modificat decât printr-un act normativ de nivelul legii, fiind necesar ca măsura prorogării să fie adoptată anterior împlinirii termenului de către titularii obligației,

luând în considerare necesitatea modificării competenței organului fiscal central în domeniul administrării contribuabililor mijlocii, precum și necesitatea reorganizării Agenției Naționale de Administrare Fiscală pentru acești contribuabili și situația extraordinară ce se poate crea prin imposibilitatea administrării contribuabililor mijlocii în lipsa unor structuri competente,

pentru evitarea impactului negativ asupra colectării creanțelor bugetare,

având în vedere faptul că aceste situații aduc atingere interesului public general și constituie un motiv de urgență deosebită și extraordinară, a cărei reglementare nu poate fi amânată,

în temeiul art. 115 alin. (4) din Constituția României, republicată,

Guvernul României adoptă prezenta ordonanță de urgență.

Articolul 1

Termenul prevăzut la art. II din Legea nr. 30/2018 pentru completarea art. 30 din Legea nr. 207/2015 privind Codul de procedură fiscală, publicată în Monitorul Oficial al României, Partea I, nr. 49 din 18 ianuarie 2018, se prorogă până la data de 1 noiembrie 2018.

Articolul 2

Până la data de 1.08.2018 Agenția Națională de Administrare Fiscală (ANAF) elaborează proiectul de hotărâre a Guvernului de modificare și completare a Hotărârii Guvernului nr. 520/2013 privind organizarea și funcționarea Agenției Naționale de Administrare Fiscală, cu modificările și completările ulterioare, prin care să declanșeze procedurile de implementare a Legii nr. 30/2018 pentru completarea art. 30 din Legea nr. 207/2015 privind Codul de procedură fiscală, în sensul preluării administrării contribuabililor mijlocii de către organele fiscale de la nivel județean și a municipiului București.
