pentru completarea Hotărârii Guvernului nr. 523/1997 privind asigurarea pazei obiectivelor, bunurilor şi valorilor cu efective de jandarmi

În temeiul prevederilor art. 107 din Constituţia României şi ale art. 6 şi 7 din Legea nr. 18/1996 privind paza persoanelor, obiectivelor, bunurilor şi valorilor, cu modificările şi completările ulterioare,

Guvernul României adopta prezenta hotărâre.

Articolul 1

Anexa nr. 1 la Hotărârea Guvernului nr. 523/1997 privind asigurarea pazei obiectivelor, bunurilor şi valorilor cu efective de jandarmi, publicată în Monitorul Oficial al României, Partea I, nr. 249 din 23 septembrie 1997, cu modificările şi completările ulterioare, se completează la capitolul III "Obiective economice", punctul 1, cu:

- Obiectivul "Conductele magistrale de transport produse petroliere, ţiţei, gazolina, etan, condensat, gaze naturale, echipamentele şi instalaţiile aferente acestora, deţinute de operatorii licentiati: Societatea Naţionala a Petrolului «Petrom» -S.A. -Sucursala «Petrotrans» Ploiesti şi Societatea Comercială «Conpet» - S.A., mai puţin staţiile de pompare sau comprimare şi capacitatile de depozitare".

Articolul 2

(1) Pentru asigurarea pazei obiectivului prevăzut la art. I efectivele Ministerului de Interne se suplimenteaza cu 3.202 posturi, din care: 137 posturi de ofiţeri, 17 de maiştri militari, 360 de subofiteri, 2.393 de jandarmi angajaţi pe bază de contract, 47 de personal civil şi 248 de militari în termen la Jandarmeria Română. ... (2) Finanţarea pentru posturile prevăzute la alin. (1) se asigura integral din venituri extrabugetare realizate din prestarea serviciului de paza. ...

Articolul 3

(1) Luarea în paza a obiectivului prevăzut la art. I se face în baza şi în condiţiile stabilite prin contractele de prestări de servicii încheiate între operatorii licentiati ai conductelor şi unităţile de jandarmi prestatoare, la nivelul esalonului care are organ financiar propriu. ... (2) Plata prestaţiei de paza cu efective de jandarmi se face în mod corespunzător din bugetul operatorilor licentiati ai conductelor şi se include în tariful de transport al operatorului. ...

Articolul 4

Prezenta hotărâre intră în vigoare la 90 de zile de la data publicării ei în Monitorul Oficial al României, Partea I.
