pentru aprobarea Ordonanţei de urgenţă a Guvernului nr. 95/2003 privind preluarea de către Autoritatea pentru Valorificarea Activelor Bancare a unor creanţe bugetare în vederea încasării şi virării lor la Fondul naţional unic de asigurări sociale de sănătate

Parlamentul României adoptă prezenta lege.

Articolul UNIC

Se aprobă Ordonanţa de urgenţă a Guvernului nr. 95 din 14 octombrie 2003 privind preluarea de către Autoritatea pentru Valorificarea Activelor Bancare a unor creanţe bugetare în vederea încasării şi virării lor la Fondul naţional unic de asigurări sociale de sănătate, publicată în Monitorul Oficial al României, Partea I, nr. 727 din 17 octombrie 2003, cu următoarele modificări şi completări:

1. Articolul 2 va avea următorul cuprins:

"Art. 2. - (1) În scopul cesiunii prevăzute la art. 1, CNAS şi AVAB vor stabili măsurile necesare pentru transferul prin protocol al creanţelor bugetare de la casele de asigurări sociale de sănătate prevăzute în Ordonanţa de urgenţă a Guvernului nr. 150/2002 privind organizarea şi funcţionarea sistemului de asigurări sociale de sănătate, cu modificările ulterioare, către AVAB. Creanţele vor fi cesionate la valoarea determinată conform Ordonanţei Guvernului nr. 61/2002 privind colectarea creanţelor bugetare, republicată, cu modificările ulterioare, înregistrată în evidenţele contabile ale acestora la data de 30 iunie 2003.

(2) În vederea valorificării, creanţele bugetare preluate se consolidează în dolari americani, pe baza raportului leu/dolar de la data preluării acestora prin protocol." ...

2. Alineatul (2) al articolului 5 va avea următorul cuprins:

"(2) CNAS va notifica debitorilor transferul creanţelor bugetare, în termen de 10 zile de la data transferului, prin înştiinţare colectivă, publicată în Monitorul Oficial al României, Partea a IV-a."

3. După alineatul (2) al articolului 6 se introduce alineatul (2^1) cu următorul cuprins:

"(2^1) Prin derogare de la prevederile art. 58 din Ordonanţa de urgenţă a Guvernului nr. 51/1998, republicată, executarea silită asupra tuturor bunurilor aparţinând debitorilor va începe prin somaţie colectivă pentru plata în termen de 10 zile lucrătoare de la data afişării somaţiei la casele de asigurări sociale de sănătate."

4. Articolul 8 se abrogă.

Această lege a fost adoptată de Senat în şedinţa din 13 noiembrie 2003, cu respectarea prevederilor art. 76 alin. (2) din Constituţia României, republicată.
