LEGE nr. 177 din 9 iunie 2005

pentru completarea art. 9 din Ordonanţa Guvernului nr. 39/1998 privind activitatea de standardizare naţională

Parlamentul României adoptă prezenta lege.

Articolul I

La articolul 9 din Ordonanţa Guvernului nr. 39/1998 privind activitatea de standardizare naţională, publicată în Monitorul Oficial al României, Partea I, nr. 43 din 30 ianuarie 1998, aprobată cu modificări şi completări prin Legea nr. 355/2002, se introduc trei alineate noi, alineatele (4), (5) şi (6), cu următorul cuprins:

"(4) Autorităţile şi instituţiile cu funcţie de reglementare au obligaţia să consulte Asociaţia de Standardizare din România - ASRO atunci când promovează acte normative care vor cuprinde norme bazate pe standarde naţionale române, europene sau internaţionale.

(5) Referirile la standardele naţionale, europene sau internaţionale, în actele normative, trebuie să prevadă explicit că aplicarea standardelor reprezintă o modalitate recomandată pentru asigurarea conformităţii cu cerinţele din actele normative respective. ... (6) Fac excepţie de la prevederile alin. (5) actele normative în care referirile la standarde naţionale, europene sau internaţionale se fac potrivit reglementărilor europene pe care acestea le transpun, precum şi actele normative care fac referire la aceste standarde din considerentele prevăzute la art. 6 alin. (2), cu respectarea principiilor şi cerinţelor ce decurg din convenţiile şi acordurile internaţionale la care România este parte." ...

Articolul II

Ordonanţa Guvernului nr. 39/1998 privind activitatea de standardizare naţională, aprobată cu modificări şi completări prin Legea nr. 355/2002, precum şi cu modificările aduse prin prezenta lege, se va republica dându-se textelor o nouă numerotare.

Această lege a fost adoptată de Parlamentul României, cu respectarea prevederilor art. 75 şi ale art. 76 alin. (2) din Constituţia României, republicată.
