DECRET-LEGE nr. 12 din 10 ianuarie 1990

privind abrogarea şi modificarea unor dispoziţii din Codul penal şi din Codul de procedură penală

Consiliul Frontului Salvării Naţionale decretează:

Articolul 1

Denumirea titlului I din partea specială a Codului penal se modifica din "Infracţiuni contra securităţii statului" în "Infracţiuni contra statului".

Articolul 2

Sînt şi rămîn abrogate următoarele dispoziţii din Codul penal: art. 164 (sabotajul), art. 166 alin. 2 (propaganda împotriva orinduirii socialiste), art. 245 (trecerea frauduloasă a frontierei) şi art. 251 (divulgarea unor secrete privind interesele obşteşti).

De asemenea, sînt şi rămîn abrogate dispoziţiile art. 206 din Codul de procedură penală privind competenţa organelor de cercetare ale securităţii.

Articolul 3

Intrarea sau ieşirea din ţara prin trecerea frauduloasă a frontierei constituie contravenţie şi se sancţionează cu închisoare contravenţională de la 15 zile la 30 de zile sau cu amendă de la 1.000 lei la 5.000 lei.
