pentru ratificarea Convenţiei-cadru privind protecţia şi dezvoltarea durabila a Carpatilor, adoptată la Kiev la 22 mai 2003

Parlamentul României adopta prezenta lege.

Articolul 1

Se ratifica Convenţia-cadru privind protecţia şi dezvoltarea durabila a Carpatilor, adoptată la Kiev la 22 mai 2003 şi intrata în vigoare la 4 ianuarie 2006, semnată de Guvernul României la data de 22 mai 2003.

Articolul 2

Cu ocazia depunerii instrumentului de ratificare, Guvernul României este autorizat sa formuleze următoarea rezerva:

"Guvernul României considera sintagma regiunea Carpaţi, din articolul 1 paragraful 1 al Convenţiei-cadru privind protecţia şi dezvoltarea durabila a Carpatilor, ca desemnând zona montană carpatica, aceasta fiind delimitata, pe teritoriul României, în conformitate cu criterii fizico-geografice, biologice, socioeconomice, legate de posibilităţile de utilizare a terenului şi modalităţile de raportare a populaţiei locale la condiţiile fizice specifice ale mediului înconjurător, precum şi cu criteriile Comunităţii Europene privind delimitarea regiunilor biomontane, stabilite în baza Directivei 92/43/CE privind conservarea habitatelor naturale şi a speciilor de flora şi fauna sălbatică. Astfel, sintagma regiunea Carpaţi, din articolul 1 paragraful 1 al Convenţiei-cadru privind protecţia şi dezvoltarea durabila a Carpatilor, semnată la Kiev la 22 mai 2003, desemnează pe teritoriul României Muntii Carpaţi cu depresiunile intramontane, fără a include Platoul Transilvaniei şi dealurile subcarpatice, conform hârtii prevăzute în anexa."

Articolul 3

Anexa prevăzută la art. 2 face parte integrantă din prezenta lege.

Această lege a fost adoptată de Parlamentul României, cu respectarea prevederilor art. 75 şi ale art. 76 alin. (2) din Constituţia României, republicată.
