LEGE nr. 483 din 19 decembrie 2006

pentru aprobarea Ordonanţei Guvernului nr. 36/2006 privind instituirea preţurilor locale de referinţă pentru energia termică furnizată populaţiei prin sisteme centralizate

Parlamentul României adoptă prezenta lege.

Articolul UNIC

Se aprobă Ordonanţa Guvernului nr. 36 din 2 august 2006 privind instituirea preţurilor locale de referinţă pentru energia termică furnizată populaţiei prin sisteme centralizate, adoptată în temeiul art. 1 pct. VII.9 din Legea nr. 288/2006 privind abilitarea Guvernului de a emite ordonanţe, publicată în Monitorul Oficial al României, Partea I, nr. 692 din 14 august 2006, cu următoarele modificări şi completări:

1. La articolul 3, alineatul (2) va avea următorul cuprins:

"(2) Autorităţile administraţiei publice locale implicate pot aproba preţuri locale mai mici sau mai mari decât cele prevăzute la art. 2 alin. (1), majorând sau diminuând astfel subvenţiile proprii necesare, după caz."

2. La articolul 3, alineatul (3) se abrogă.

3. După articolul 5 se introduce un nou articol, articolul 5^1, cu următorul cuprins:

"Art. 5^1. - Sumele acordate furnizorilor de energie termică prevăzute la art. 4 alin. (1), inclusiv sumele acordate în avans conform prevederilor art. 5 alin. (1), vor fi virate de către autorităţile administraţiei publice locale furnizorilor de energie termică în termen de 15 zile de la prezentarea deconturilor justificative, în conturi de tip ESCROW, deschise la bănci de către producătorii de energie termică."

4. Articolul 6 va avea următorul cuprins:

"Art. 6. - Autorităţile administraţiei publice locale implicate vor emite acte administrative prin care să se prevadă pentru fiecare operator economic al serviciilor de producere, transport, furnizare şi distribuţie a energiei termice:

a) natura şi întinderea obligaţiilor prestării serviciului public; ... b) operatorul economic şi teritoriul implicat; ... c) natura drepturilor speciale sau exclusive acordate operatorului economic în cauză; ... d) parametrii pentru calcularea compensaţiilor, precum şi a unui profit rezonabil pentru operatorii economici care prestează serviciul public; ... e) modalităţile de recuperare a supracompensărilor şi de intervenţie a autorităţii în cazul subcompensărilor." ...

5. Articolul 7 va avea următorul cuprins:

"Art. 7. - Parametrii pe baza cărora este calculată compensarea pentru serviciul public vor fi stabiliţi prin act administrativ, într-o manieră obiectivă şi transparentă. Totodată, aceştia trebuie să fie identici pentru toţi operatorii economici care îndeplinesc aceleaşi obligaţii de serviciu public."

6. La articolul 9, alineatul (1) va avea următorul cuprins:

"Art. 9. - (1) Schema de ajutor de stat conţinută de prezenta ordonanţă este notificată Consiliului Concurenţei de Ministerul Administraţiei şi Internelor, conform reglementărilor în vigoare în domeniul ajutorului de stat, iar acordarea alocărilor individuale se face efectiv numai după autorizarea schemei de către Consiliul Concurenţei."

Această lege a fost adoptată de Parlamentul României, cu respectarea prevederilor art. 75 şi ale art. 76 alin. (2) din Constituţia României, republicată.
