ORDONANŢĂ DE URGENŢĂ nr. 36 din 9 mai 2007

pentru abrogarea Legii nr. 476/2003 privind aprobarea taxei de notificare a prelucrărilor de date cu caracter personal, care cad sub incidenţa Legii nr. 677/2001 pentru protecţia persoanelor cu privire la prelucrarea datelor cu caracter personal şi libera circulaţie a acestor date

Având în vedere:

- aderarea României la Uniunea Europeană la 1 ianuarie 2007 şi monitorizarea implementării acquis-ului comunitar;

- necesitatea stabilirii unui cadru legal în concordanţă cu prevederile Directivei 95/46/CE a Parlamentului European şi a Consiliului privind protecţia persoanelor fizice cu privire la prelucrarea datelor cu caracter personal şi libera circulaţie a acestor date, prin care se statuează libera circulaţie a datelor cu caracter personal între statele membre ale Uniunii Europene;

- prevederile art. 1 alin. (2) din Directiva 95/46/CE , potrivit cărora statele membre nu pot limita sau interzice libera circulaţie a datelor cu caracter personal între ele, din motive legate de protecţia datelor;

- faptul că prevederile Legii nr. 476/2003 constituie un impediment în calea liberei circulaţii a datelor cu caracter personal între statele membre ale Uniunii Europene şi din zona economică europeană, contravenind prevederilor Directivei 95/46/CE şi putând atrage aplicarea unor sancţiuni din partea organismelor comunitare, situaţie ce impune promovarea de urgenţă a măsurii de abrogare a acestei legi,

în temeiul art. 115 alin. (4) din Constituţia României, republicată,

Guvernul României adoptă prezenta ordonanţă de urgenţă.

Legea nr. 476/2003 privind aprobarea taxei de notificare a prelucrărilor de date cu caracter personal, care cad sub incidenţa Legii nr. 677/2001 pentru protecţia persoanelor cu privire la prelucrarea datelor cu caracter personal şi libera circulaţie a acestor date, publicată în Monitorul Oficial al României, Partea I, nr. 814 din 18 noiembrie 2003, se abrogă.
