LEGE nr. 214 din 20 aprilie 2001

pentru aprobarea Ordonanţei Guvernului nr. 136/2000 privind măsurile de protecţie împotriva introducerii şi răspândirii organismelor de carantina dăunătoare plantelor sau produselor vegetale în România

Articolul UNIC

Se aprobă Ordonanţa Guvernului nr. 136 din 31 august 2000 privind măsurile de protecţie împotriva introducerii şi răspândirii organismelor de carantina dăunătoare plantelor sau produselor vegetale în România, emisă în temeiul art. 1 lit. E pct. 4 din Legea nr. 125/2000 privind abilitarea Guvernului de a emite ordonanţe şi publicată în Monitorul Oficial al României, Partea I, nr. 431 din 2 septembrie 2000, cu următoarele modificări:

1. Alineatul (4) al articolului 3 va avea următorul cuprins:

"(4) Direcţiile fitosanitare judeţene, respectiv a municipiului Bucureşti, sunt unităţi cu personalitate juridică în subordinea direcţiilor generale pentru agricultura şi industrie alimentara judeţene, respectiv a municipiului Bucureşti."

2. Alineatul (2) al articolului 9 va avea următorul cuprins:

"(2) Înregistrarea nu este obligatorie pentru micii producători sau prelucratori de plante, produse vegetale sau articole reglementate a căror producţie şi/sau vânzare sunt destinate autoconsumului sau pieţei locale pentru utilizare de către persoane care nu sunt implicate profesional în producerea de seminţe şi material săditor, destinate multiplicării, cu excepţia situaţiilor în care exista pericolul răspândirii organismelor de carantina."

3. Alineatul (1) al articolului 15 va avea următorul cuprins:

"Art. 15. - (1) Faptele prevăzute la art. 16-20 constituie contravenţii la normele privind măsurile de protecţie împotriva introducerii şi răspândirii organismelor de carantina dăunătoare plantelor, produselor vegetale şi a articolelor reglementate în România, dacă nu sunt săvârşite în astfel de condiţii încât să fie considerate infracţiuni, potrivit legii penale."

4. Alineatul (3) al articolului 21 va avea următorul cuprins:

"(3) Sancţiunile prevăzute se aplică persoanelor fizice şi juridice."

5. În tot cuprinsul ordonanţei, sintagmele Ministerul Agriculturii şi Alimentaţiei, Agenţia Naţionala Fitosanitara, Ministerul Finanţelor şi ministrul agriculturii şi alimentaţiei se înlocuiesc cu sintagmele Ministerul Agriculturii, Alimentaţiei şi Pădurilor, Direcţia fitosanitara din cadrul Ministerului Agriculturii, Alimentaţiei şi Pădurilor, Ministerul Finanţelor Publice şi ministrul agriculturii, alimentaţiei şi pădurilor.

Această lege a fost adoptată de Camera Deputaţilor în şedinţa din 26 martie 2001, cu respectarea prevederilor art. 74 alin. (2) din Constituţia României.
