LEGE nr. 395 din 14 iunie 2002

pentru aderarea României la Convenţia privind admiterea temporară, adoptată la Istanbul la 26 iunie 1990

Parlamentul României adopta prezenta lege.

Articolul 1

România adera la Convenţia privind admiterea temporară, adoptată la Istanbul la 26 iunie 1990.

Articolul 2

În virtutea art. 24 paragraful 4 din convenţie, România accepta toate anexele la aceasta.

Articolul 3

Cu ocazia depunerii instrumentului de ratificare, în virtutea art. 29, se vor formula următoarele rezerve:

a) Anexa A privind titlurile de admitere temporară (carnete ATA şi carnete CPD) ...

Rezerva: în aplicarea art. 18 paragraful 1, tariful poştal nu este acoperit de legislaţia română referitoare la carnetul ATA;

b) Anexa B.3 privind containerele, paletele, ambalajele, mostrele şi alte mărfuri importate în cadrul unei operaţiuni comerciale ...

Rezerva: în aplicarea art. 7 lit. b), legislaţia română cere în anumite situaţii prezentarea unui document vamal şi constituirea unei garanţii pentru containere, palete şi ambalaje;

c) Anexa B.5 privind mărfurile importate în scop educativ, ştiinţific sau cultural ...

Rezerva: în aplicarea art. 6, în ceea ce priveşte materialul ştiinţific şi pedagogic, legislaţia română prevede că acesta trebuie supus formalităţilor vamale de plasare sub regimul de admitere temporară;

d) Anexa C privind mijloacele de transport ...

Rezerva: în aplicarea art. 10 lit. b), în ceea ce priveşte vehiculele rutiere pentru uz comercial şi mijloacele de transport pentru uz particular, legislaţia română prevede că un document vamal însoţit, dacă este cazul, de o garanţie poate fi cerut în anumite cazuri;

e) Anexa E privind mărfurile importate cu suspendarea parţială a drepturilor şi taxelor de import ...

Rezerva: în aplicarea art. 9, în ceea ce priveşte suspendarea parţială a taxelor de import, legislaţia română prevede exonerarea parţială de la plata taxelor vamale, dar nu prevede suspendarea parţială a drepturilor de import.

În legătură cu art. 32 paragraful 3 din convenţie, România declara ca, potrivit legislaţiei române, intrarea în vigoare a amendamentelor va avea loc după ratificarea acestora, conform legii.

Această lege a fost adoptată de Camera Deputaţilor în şedinţa din 7 mai 2002, cu respectarea prevederilor art. 74 alin. (2) din Constituţia României.
