pentru ratificarea Memorandumului de finanţare dintre Guvernul României şi Comisia Europeană privind asistenţa financiară nerambursabilă acordată prin Instrumentul pentru Politici Structurale de Preaderare pentru măsura "Îmbunătăţirea sistemelor de alimentare cu apă potabilă, colectare a apelor uzate şi a staţiei de epurare în municipiul Satu Mare, Regiunea de Nord-Vest, România", semnat la Bruxelles la 13 decembrie 2002 şi la Bucureşti la 31 martie 2003

Parlamentul României adoptă prezenta lege.

Articolul 1

Se ratifică Memorandumul de finanţare dintre Guvernul României şi Comisia Europeană privind asistenţa financiară nerambursabilă acordată prin Instrumentul pentru Politici Structurale de Preaderare pentru măsura "Îmbunătăţirea sistemelor de alimentare cu apă potabilă, colectare a apelor uzate şi a staţiei de epurare în municipiul Satu Mare, Regiunea de Nord-Vest, România", semnat la Bruxelles la 13 decembrie 2002 şi la Bucureşti la 31 martie 2003.

Articolul 2

(1) În cadrul contractelor încheiate cu contractorii locali pentru executarea de lucrări, furnizarea de bunuri şi servicii decontările pot fi efectuate şi în euro. ... (2) Sumele necesare continuării finanţării proiectului în cazul indisponibilităţii temporare a contribuţiei comunitare ISPA se prevăd în bugetul de stat la alineatul "Transferuri aferente Fondului naţional de preaderare", în bugetul Ministerului Finanţelor Publice - "Acţiuni generale" şi se transferă autorităţii responsabile cu implementarea măsurii - Oficiul de Plăţi şi Contractare PHARE, urmând a se regulariza cu fondurile transferate de către Comisia Europeană, în limita sumelor eligibile cheltuite. ... (3) În cazul în care sumele prevăzute la alin. (2) vor fi cheltuite în alt scop decât cel prevăzut în memorandumul de finanţare, beneficiarul final va restitui aceste sume la bugetul de stat. ...

Această lege a fost adoptată de Senat în şedinţa din 23 iunie 2003, cu respectarea prevederilor art. 74 alin. (2) din Constituţia României.
